Payment

Payment for first orders is due prior to the goods being despatched. On receipt of your order we will advise approximate delivery dates. We will then contact you when the goods are ready for despatch ask for payment. A full UK VAT invoice will be enclosed with the goods. Payment for subsequent orders is due within 30 days of despatch of the goods.

Delivery

Delivery times are approximately 5 weeks. Please ask if there are special circumstances or faster delivery is needed. Orders from within the UK under £300 will be subject to a delivery and packing charge of £17 or cost whichever is lower. Orders from within the UK over £300 will be delivered free of charge. Orders from outside the UK will be subject to postage and packaging at cost. Thelermont Hupton use Royal Mail/Parcelforce and couriers for delivery.

Products

Every care is taken to ensure descriptions, colours and measurements are accurate, however slight variations may occur. Thelermont Hupton reserve the right to change details.

We make every effort to ensure colours appear as realistic as possible. However due to the constraints of digital reproduction on different web browsers, we cannot guarantee exact colour depiction.

Cancellation

We reserve the right to cancel the contract between us if:

• We are unable to get sufficient stock to deliver the goods you have ordered
• We do not deliver to your area
• One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

We will not be obliged to offer any additional compensation for disappointment suffered.

Liability

If the goods we deliver are not what you ordered, are damaged or defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us of the problem in writing within 7 working days of the delivery of the goods in question. If you notify a problem to us under this condition, our only obligation will be, at your option:

• To make good any shortage or non-delivery
• To replace or repair any goods that are damaged or defective
• To refund to you the amount paid by you for the goods in question

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase. Notwithstanding the foregoing, nothing in these Terms and Conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Notices

Unless otherwise expressly stated in these Terms & Conditions, all notices from you to us must be in writing and sent to us at Thelermont Hupton, 114 Rutland Gardens, London, N4 1JR

Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity

If any part of these Terms & Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Privacy

You acknowledge and agree to be bound by the terms of our Privacy Policy.

Third party rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Entire agreement

These Terms and Conditions, together with our current contact details and Privacy Policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Thelermont Hupton respects the privacy rights of our online visitors and recognises the importance of protecting the information we collect about you. Therefore we have adopted a Privacy Policy that guides how we collect, store and use the information that you provide us with. (This policy applies only to sites maintained by Thelermont Hupton and not to websites maintained by other companies or organisations to which we provide links.)

Personal information

Thelermont Hupton only collects personal information from our online visitors on a voluntary basis, and only during registration, placing an order and general use of the site. Personal information collected may include your name, email address, phone numbers, home address, delivery address. We do not require this information in order for you to obtain access to the sites. (Your telephone number may be given to our courier to facilitate deliveries). These details allow us to process your order and to let you know the status of your order.

How this information may be used

When you register with Thelermont Hupton, you will be asked to provide personally identifiable information. The information you provide allows us to alert you to new products, services, special offers/promotions, news and events. We will not share your information with parties outside our organisation (except to the extent required by law, court order, or as requested by other government or law enforcement authority). If at any point you wish to have your name removed from our database, you can do so by sending an email to info@thelermonthupton.com with the subject 'unsubscribe'.

Safeguarging personal information

We will only collect personally identifiable information to the extent deemed reasonably necessary to serve our legitimate business purposes, and we will maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided us with. By using this site, you signify your consent to the Thelermont Hupton Privacy Policy. If you do not agree to this policy, please do not use this site. We reserve the right to make changes to this policy. Please check back from time to time to ensure you are aware of any changes in our privacy practices. Your continued use of our site will signify your acceptance of these changes. Under no circumstances will we pass on your personal details to any other company other than for the purpose of delivery of your order.
